<h3 >Green Palm Springs Rentals Short-Term Guest Vacation Rental Agreement</h3> <p>You are agreeing to all of terms of this Agreement when you book on-line or off-line, and you agree (per local City regulations) 1) to provide a copy of your State Driver’s License, 2) you either sign this agreement or you agree to these terms when making an on-line booking, 3) you and all adults in your group agree to read and sign the City-provided Vacation Rental Rules and Regulations Sheet upon check-in, and 4) you agree to provide the make and license number for each vehicle that will be at the property. (Sorry for all the red tape, but these are the City’s rules that we must comply with.)</p> <p>TEMPORARY STAY AGREEMENT: This Vacation Rental Agreement is made and entered into between Green Palm Springs Rentals LLC (also referred to as “GPSR” and “Property Manager”) and you, the “Renter”. The Renter along with all overnight occupants of the house are referred to as “Guests”. People who are invited to visit the property but not stay overnight are referred to as “Visitors”. GPSR is acting on behalf of the property “Owners”. The “Booking Process” is the specific process used by the Renter to book/reserve the property using their credit card payment. This agreement has a specific start date and end date that correspond to your booked reservation, and Renter acknowledges that no holdover or extension beyond the end date is allowed. This agreement is not a lease and conveys no rights in real property. By agreeing to these terms and conditions, you stipulate that you have not and will not receive a real property interest in or other occupancy rights to the vacation rental property. In addition to the terms and conditions of this Agreement, Guest agrees to abide by any governing HOA/Condominium Association rules where applicable.</p> <p>This contract is entered into agreement as of the date when the Renter places their reservation online and the reservation is screened and accepted by GPSR. GPSR will notify the Renter by email when their reservation is accepted/confirmed.</p> <p>The Renter must be 25 years of age or older and one of the occupants of the house. If renting in Rancho Mirage, the renter must be 30 years of age of older and one of the occupants of the property.</p> <p>PAYMENT: Renter agrees to make all payments per the Payment Schedule as specified during the Booking Process. Renter understands and agrees that their reservation is contingent upon GPSR having received final and full payment for rental of the Property and all checks or credit card charges have cleared. Any reservation obtained under false pretense will be subject to forfeiture of all advance payments; Renter will not be permitted to check in and forfeit all rights under this Rental Agreement.</p> <p><br>CHECK-IN/CHECK-OUT: Check-in time is 3:00 P.M. (PST) and Check-out time is 10:00 A.M. (PST). Requests for approval to arrive early or leave late may be made in advance of the respective date. If available, an Early Check-In Fee or Late Check-Out Fee will apply, depending on the request and time of year. Entering the house before your approved check-in time or leaving after your approved check-out time will result in a $250 Unapproved Late Check-out/Unapproved Early Check-in Fee. We are sorry if this sounds harsh, but we need advance notice of any schedule changes to ensure that we can meet commitments to future guests about their check-in time.</p> <p>ASSUMPTION OF RISK – RELEASE OF LIABILITY – HOLD HARMLESS AGREEMENT: Renter, Guests and Visitors all agree to indemnify, defend and hold harmless GPSR, Owner and Owners’ representatives/service agents from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage, bodily injury, accident, illness, paralysis, and death to the fullest extent permitted by law, irrespective of any alleged negligence of GPSR, Owners and Owners’ representatives/service agents.</p> <p>Renter, Guests and Visitors understand that no special efforts have been made to “child-proof” or “dog-proof” this house and yard, and Renter, Guests and Visitors accept the risk or harm to any children or pets on the property. These risks are not limited to, but include access to the pool/spa, fire or sharp glass in the fireplace(s) and/or fire pit(s), toxic cleaning supplies in the house/garage, and plants in the yard that might be sharp upon contact or poisonous if ingested. There may not be any alarms on doors or gates to the pool area. Renter’s and Guests’ personal supervision is absolutely required to avoid the risk of serious injury and/or death to children, in particular.</p> <p>NON-SMOKING HOUSE: The house is strictly a non-smoking house. Ashtrays are provided for outside use and both Guests and Visitors agree to take care that smoke does not blow into any open windows or doors”. Butts are to be disposed of safely and not left “anywhere” on the property. If housekeeping detects smoke in the house, Renter is responsible for all costs related to the elimination all smoke damage even if it is beyond the value of their Security/Damage Deposit.</p> <p>PET(S): Well-behaved, flea-free, “pre-approved” Dogs are permitted, but require prior approval. A taxable per pet fee applies, limit of 2. Pet owners are responsible for cleaning up after their pets in the front and back yards as well as on walks in the neighborhood. Please ensure that the lawn areas are cleaned up BEFORE the gardeners arrive (See House Guide Binder for their schedule). Unapproved Dog Fee Is $500+tax. Any required yard cleaning of dog feces is a minimum $100 Fee. Guest agrees to contact GPSR to seek pre-approval for Dog(s) well in advance of the check-in date and to arrange payment of the $150 Per Dog Fee (taxable). We’re sorry, but only Dogs are allowed. We reserve the right to refuse admittance of certain dog breeds (as limited by some Home Insurance Policies); please tell us your dog’s breed when you book. Official Certified Service Dogs performing a stated function are welcome without a fee, but still must be disclosed in advance of check-in.</p> <p>DAMAGE PROTECTION FEE / SECURITY DEPOSIT WAIVER : Your reservation cost includes a Damage Protection Fee (called a Management Fee on Airbnb). This covers Guest for up to $2,500 of accidental damage/loss during their stay at the property. Should damage/loss exceed $2,500, Guest agrees to pay for the additional damage/loss and agrees that such charges will be charged to any credit card on file.</p> <p>SECURITY DEPOSIT OPTION: If the Damage Protection Fee is declined, an additional $2,500 security deposit is required to be paid 30 days prior to arrival.  Any damages caused by Guest will be deducted from that security deposit.  Should damages exceed security deposit, Guest agrees that any additional damage will be charged to any credit card on file. www.waivo.io/green-palm-springs-rentals/</p> <p>UTILITY DEPOSIT FOR MONTHLY RENTALS: For monthly rentals, the cost of Natural Gas and Electric Utilities is not included in the rent. An Advance Utility Deposit will be required to be paid 30 days before arrival and it may take up to 45 days after the check-out date to reconcile and refund any remaining balance due to Utility Company billing cycles.</p> <p>TRASH: All trash is to be placed “in plastic bags” and taken to the BLACK/BROWN bin at the side of the house. All recycling is to be placed in the BLUE/GREY recycle bin. PLEASE DO NOT copy the neighbors and roll the bins to the street on collection day. The trash collectors are paid additional to do that for you, and it will confuse them if you roll it to the street for them. They will return the bins beside the house later in the day after the contents have been collected.</p> <p>DISHES: You are expected to wash your own dishes before leaving. It is okay to load and start the dishwasher before leaving; you don’t have to stay and empty it.</p> <p>USED LINENS/TOWELS: At Check-out, please leave the beds unmade so housekeeping clearly knows which ones were used. Please don’t leave moist towels on top of any wood or cloth furniture. Also, please don’t leave moist towels in a large pile; they quickly mildew in the desert heat. Please don’t start a load of sheets or towels in the washer before leaving unless you are sure you will be there to move the wet laundry to the dryer and start the drying process. Wet laundry left in the washer will mildew quickly.</p> <p>UMBRELLAS/AWNINGS: All Patio Umbrellas and Awnings are closed when not in use. Umbrellas and Awnings must be kept closed when windy to prevent them from being damaged. Additionally, Awnings are for Sun protection, not Rain protection. Close Awnings if Rain is expected as Rain can damage them.</p> <p>DOORS/WINDOWS: All Doors and windows are shut and locked when no one is home.</p> <p>KEYS/GARAGE REMOTE: Upon departure, Keys and Garage Door Openers should be left where they were found. Please double check that Garage Door Openers are removed from your vehicles. Lost keys or garage door openers will incur re-keying/re-programming costs of $50 each and $100 each respectively.</p> <p>FURNITURE: All furniture (inside AND outside) must be returned to its original location on Renter’s departure or an additional charge will be made depending on the extent of the re-arranging required.</p> <p>GOOD NEIGHBOR POLICY /OUTSIDE MUSIC: Palm Springs, Rancho Mirage and Cathedral City have very strict Vacation Rental Ordinances as it relates to noise. Absolutely no music is allowed to be heard outside. Music from inside the house must not be at audible levels when outside the property. If a neighbor calls the Vacation Rental Hotline, you will be fined a minimum $500 (Palm Springs) – $1000 (Cathedral City) AND EVICTED. Our neighbors are very nice and very reasonable, BUT they also have the GPSR phone number to call if there is a violation of this policy. In addition to any fines levied by Vacation Rental Code Enforcement, Renter will forfeit their entire Security/Damage Deposit and the value of any unused vacation rental nights will not be refunded. We know this sounds harsh for just playing music, but that’s the law and we can lose our Vacation Rental License if you violate it. We absolutely want you to have a fun and enjoyable vacation experience, but not at the expense of our ability to operate our vacation rental business, nor at the expense of our neighbors’ right to a peaceful neighborhood.</p> <p>GOOD NEIGHBOR POLICY/PARKING: At all times, parking is limited to “one vehicle per bedroom”. Please park all vehicles in the garage, carport or driveway. Avoid street parking spaces that are in front/adjacent to our property.</p> <p>CANCELLATIONS: Cancellation Policy is specified at the time of booking. If not otherwise specified, Cancellations made at least 60 days prior to check-in date are fully refundable. Date Changes made at least 60 days before your check-in date will be made without a change fee, however, the rental rate may be different for any new dates. If a Guest cancels, or shortens their stay, less than 60 days prior to check in, there is no refund. Early departure does not warrant any refund of rent.</p> <p>TRAVEL INSURANCE: GPSR does not provide Travel Insurance. If Guests desire travel insurance, Guests need to acquire that from a 3rd party vendor.</p> <p>MAXIMUM OCCUPANCY: The maximum number of Overnight Adult Guests is 2 persons per bedroom. In addition, 2 children under 3 may stay there.  The presence of Unapproved Overnight Adult Guests beyond 2 per bedroom will result in eviction and a loss of all monies paid including your entire security deposit, with no refund of the value of any unused vacation rental nights.</p> <p>NO UNAPPROVED PARTIES: This is not a party house. ANY GATHERING of more than 2 persons per bedroom must be disclosed at the time the reservation is made and is subject to Owner’s advanced approval. Prom parties, bachelor/bachelorette parties, fraternity or sorority parties and graduation parties are not allowed at any time. </p> <p>DAYTIME VISITORS<br>No Daytime Visitors beyond the approved house Guests are allowed in Cathedral City vacation homes. In Palm Springs and Rancho Mirage, please refer to the provided City Regulations to understand the guidelines for Daytime Visitors and the hours this is allowed. Any occupancy over this limit will result in eviction and a loss of all monies paid including your entire security deposit.</p> <p>DEPARTURE CLEANING FEE/NO MAID SERVICE: Renter has paid a Departure Cleaning Fee which covers reasonable and ordinary cleaning and laundry service. Guests are expected to leave the house in reasonably clean condition. Refer to the House Guide Binder for a detailed list of our expectations for how you leave the house. Any excessive cleaning required will result in an Excessive Cleaning Fee of at least $100. (Did you remember to clean the Grill? Are all the dishes/pans washed or at least placed in the dishwasher and started before you leave?) If you require mid-stay cleaning services, cleaning must be provided by the Owner’s bonded cleaning service, at a cost that can be established in advance. Contact GPRS to schedule this for you.</p> <p>ENTRY OF PREMISES: We understand and respect our Guests’ right to privacy, however, GPSR, Owner, Owner’s representative, or Owner’s servicing agent reserve the right to enter the premises, with or without Guests’ express permission, during reasonable daylight hours after providing prior notice to Renter via phone call to Renter’s cell phone on file or to the house phone. A message will be left if there is no answer. In any emergency, GPSR, Owner, Owner’s representative, or Owner’s servicing agent may enter the premises at any time with or without permission of Guest for the purposes of making emergency repairs. Guests agree to allow backyard access to the gardener(s) around mid-day each Thursday, and the pool care person around mid-day each Monday and Thursday. Both service providers have a key to the side gate(s) and will enter the property unannounced. Guests agrees to restrain dog(s) so as not to bother service providers. Renter agrees not to contract an independent service agent to perform any cleaning, repairs or service without the prior approval of GPSR.</p> <p>PERSONAL PROPERTY: If Guests leave something important behind, Guests agree to promptly notify GPSR who will try to locate said item and if found will offer to return it for a fee. However, Guests understand that their personal property is not insured by GPSR or Owners. GPSR and Owners shall not be responsible for any lost, stolen or missing property of the Guest and there is no obligation to return property of Guests that are left after check out.</p> <p>SALE CONTINGENCY OR OTHER UNAVAILABILITY: In the rare event the Property that that you have reserved is for sale, is sold or is otherwise unavailable for any reason as determined by GPSR, then GPSR, in GPSR’s sole discretion, reserves the right to provide Guest with a comparable property at no additional cost to the Guest or cancel and refund Guest’s reservation. Under no circumstance will GPSR or the Owner be responsible for any Guest expenses beyond the amount of money Guest has paid GPSR.</p> <p>SUBLETTING: Guest is not authorized to let or sublet all or any part of the premises nor assign this agreement or any interest in it.</p> <p>ARBITRATION OF DISPUTES: THIS AGREEMENT AND ANY DISPUTE BETWEEN THE PARTIES IS GOVERNED BY CALIFORNIA LAW. ANY DISPUTE BETWEEN THE PARTIES ARISING FROM OR RELATING TO A CLAIM FOR PERSONAL INJURY, WHICH IS DIRECTLY OR INDIRECTLY RELATED TO, OR ARISING FROM A CONDITION OF THE RENTED PREMISES OR THE COMMON AREAS, OR ANY EVENT THEREON, SHALL BE RESOLVED SOLELY BY ARBITRATION CONDUCTED BY THE AMERICAN ARBITRATION ASSOCIATION. Any such arbitration shall be held and conducted in the county in which the premises are located before three arbitrators, who shall be selected as follows: The claimant and respondent shall each select one arbitrator. The two selected arbitrators will then select a third arbitrator, and the three arbitrators shall constitute the panel. The provisions of the American Arbitration Association rules shall apply and govern such arbitration, subject, however, to the following: (a) Any demand for arbitration shall be made in writing and must be made within 180 days after the claim, dispute or other matter in question has arisen. In no event shall the demand for arbitration be made after the date that institution of legal or equitable proceedings based on such a matter would have been barred by the applicable statute of limitations. (b) The arbitrators’ jurisdiction extends to all punitive damages claims and call actions. (c) Each party shall bear their own respective fees and cost relative to the arbitration process, and attorneys’ fees, if awarded shall not exceed $2000.00. (d) All administrative fees and costs, including but not limited to the arbitrators’ fees relative to the arbitration process must be advanced prior to the selection of the arbitration panel and shall be borne equally by all parties. (e) The decision of the arbitrators shall be final, and judgment may be entered on it in accordance with applicable law.</p> <p>WAIVER OF JURY TRIAL: RECOGNIZING THAT JURY TRIALS ARE BOTH TIME CONSUMING AND EXPENSIVE, GPSR, OWNER, RENTER and GUESTS ALL HEREBY WAIVE THEIR RIGHT TO A TRIAL BY JURY ON ANY MATTER ARISING OUT OF THIS AGREEMENT, OR THE USE, OR THE OCCUPANCY OF THE PREMISES HEREIN.</p> <p>WRITTEN EXCEPTIONS: Any exceptions to the above-mentioned policies must be approved in writing or email.</p> <p>SIGNATURE: This document may be digitally agreed to during an on-line booking process.
